Building in Cape Verde: permits, steps and points to watch

Building on family land in Santiago, on a plot bought in Sal or on a unit in a condominium: every site follows an official logic. A permit is issued by a specific authority, the project's technicians are named, and the end of works must be formally closed. This guide does not replace your municipality's planning department: that is where questions get answered, before the first dig.

What the law calls an “urban development operation”

The framework law is the Lei n.º 60/VIII/2014, de 23 de abril, which governs “o regime jurídico das operações urbanísticas, designadamente o loteamento, a urbanização, a edificação e a utilização e conservação de edifícios”. “Edificação” therefore does not mean new construction only: the law includes reconstruction, enlargement, alteration and conservation. This law has been amended twice: by the Lei n.º 42/IX/2018, de 5 de dezembro, then by the Lei n.º 57/X/2025, de 05 de agosto.

Three forms of prior control: licence, prior communication, authorisation

Carrying out urban development operations depends on “controlo prévio”, which can take three forms: licença, comunicação prévia or autorização.

A licença is required, in particular, for operations outside a detailed plan, and for “as obras de construção, de ampliação ou de alteração em área não abrangida por plano detalhado ou operações de loteamento…”. An autorização is required for loteamento operations in an area covered by a detailed plan, for reconstruction, for demolition, and for “a utilização de edifícios ou suas fracções”.

The licença is issued by the Câmara Municipal; the autorização by the President of the Câmara Municipal, delegateable to the Vereadores. Issuing also depends on the executing company presenting an alvará: without it, “impede a concessão de licença e autorização pela Câmara Municipal”.

Do you need a permit to renovate?

Obras de conservação — works that keep a building in its existing state — are exempt from licence or authorisation. So are obras de alteração inside non-listed buildings, provided they change neither the load-bearing structure, nor the cérceas, nor the façades, nor the roof shape. Once one of those elements is touched, the exemption ends.

Other works may be exempt, but only “mediante previsão em regulamento municipal”: if your municipality's regulation so provides. The law classifies as obras de escassa relevância urbanística, among others, “a edificação de muros de vedação até 1,8 m de altura que não confinem com a via pública”. These exemptions do not apply to listed buildings, nor in protection zones.

Who is responsible on site?

The file rests on named professionals: the initial application includes a declaration by the project authors that the applicable standards are met, and only legally competent technicians may sign off on the projects. The law requires proof of their qualifications for the roles of coordenador de projecto, autor de projecto, director de fiscalização de obra and director de obra.

The coordinator, the authors and the works supervision director present a termo de responsabilidade and valid civil liability insurance; the site director must, where applicable, also prove integration into the executing company.

Finishing the site: the use authorisation

The end of works is itself subject to prior control: “a utilização de edifícios ou suas fracções” is among the operations requiring autorização. The President of the Câmara Municipal decides within thirty days, counted from receipt of the file or “da data da realização da vistoria, quando a ela houver lugar”: an inspection is therefore not automatic.

In horizontal property, the licence or use authorisation may cover the whole building or each autonomous unit; a single unit only if the common parts are also usable.

Building without authorisation: what the texts say

The full sanctions regime could not be read in primary source: for a specific case, ask the competent Câmara Municipal.

What can be stated concerns the preventive planning measures of the RNOTPU, approved by the Decreto-Lei n.º 43/2010, de 27 de setembro and amended by the Decreto-Lei n.º 61/2018, de 10 de dezembro. Within that precise framework, works carried out in breach of those measures “podem ser embargados ou demolidos”, the power lying, for municipal preventive measures, with the President of the Câmara Municipal; administrative acts granting licenciamento in breach of those measures are null. This is not a general rule.

A second finding: no general licenciamento regulation covering all municipalities could be read. Ask your municipality for its urban development regulation and its código de posturas, subject to public review for not less than thirty days and published in the Boletim Oficial. As a local example, a loteamento regulation read in Tarrafal de Santiago refers to licenciamento by the Câmara Municipal and to its fiscalização. That text is specific to its perimeter: it is not a general rule.

Points to watch

  • Check the executing company's alvará: without it, the Câmara Municipal cannot issue the licence or authorisation.
  • Name the site's technical officers in writing and keep their insurance certificates.
  • Never assume a wall is exempt: the thresholds depend on your municipality's regulation.
  • Plan for the end of works: use of the building requires authorisation.
  • Keep the whole file and track the aditamentos to the alvará.
